Terms of Service

These Terms govern your use of SDR to HDR. By creating an account or using the service you agree to them. If you do not agree, do not use SDR to HDR.

The short version

A plain-language summary. The numbered sections below are the operative text; where the two differ, the sections govern.

Who owns the converted video?

You do, both what you upload and what is rendered for you. The licence granted is limited to storing, processing and transmitting your content in order to run the service. Section 4 below is the operative wording.

What is the liability cap?

Aggregate liability for any claim is limited to what you paid in the 12 months before it, and indirect or consequential losses are excluded. The service is provided as is, without warranties, and AI output may contain artefacts. Sections 9 and 10 below.

Which law applies?

Turkish law for users in Türkiye and the law of England and Wales for everyone else. Mandatory consumer protections in your own country of residence are not affected by that choice. Section 12 below.

1. Eligibility

You must be at least 16 years old (18 in jurisdictions where 16 is below the age of digital consent) and able to enter a binding contract.

2. Account

Keep your credentials secure. You are responsible for activity on your account. We may suspend accounts that show signs of abuse, fraud, or unauthorized access.

3. The service

SDR to HDR converts standard-dynamic-range video files into 10-bit HDR10 using AI. Output quality and timing depend on third-party infrastructure and are not guaranteed. We retain the right to evolve, throttle, or temporarily suspend features.

4. Your content and license

You keep ownership of everything you upload and everything we render for you. You grant us a limited license to store, process, and transmit your content solely to operate the service. We do not use your content to train AI models.

5. Acceptable use

You must follow our Acceptable Use Policy. In short: only upload videos you have the right to use; no illegal, infringing, or harmful content. Violations may result in immediate account termination without refund.

6. Balances and billing

SDR to HDR uses dollar-denominated balances. Subscriptions (HDR-20, HDR-50, HDR-200) grant a conversion balance each billing cycle and set your per-second rate; the subscription balance resets to the plan amount at each renewal. Top-offs add balance that never expires. Charges are computed per second of video and displayed before you confirm. Polar.sh is the Merchant of Record; they invoice you and remit applicable VAT/sales tax.

7. Refunds

See the Refund Policy. Failed conversions refund automatically.

8. Termination

You may delete your account at any time. We may terminate or suspend accounts that breach these Terms or the AUP, with or without notice depending on severity.

9. Disclaimers

SDR to HDR is provided "as is" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. AI output may contain errors or unexpected artifacts.

10. Limitation of liability

To the fullest extent permitted by law, our aggregate liability for any claim relating to SDR to HDR is limited to the amount you paid us in the 12 months preceding the claim. We are not liable for indirect, incidental, consequential, or punitive damages. Nothing in these Terms limits liability that cannot be excluded under applicable law (e.g., for gross negligence, willful misconduct, or consumer rights guaranteed in your jurisdiction).

11. Indemnity

You agree to defend and hold us harmless from claims arising out of content you upload or actions you take that breach these Terms or applicable law.

12. Governing law

These Terms are governed by Turkish law for users in Türkiye and by the law of England and Wales for everyone else, without regard to conflict-of-laws rules. Mandatory consumer protections in your country of residence are not affected.

13. Changes

We may update these Terms. Material changes will be notified by email at least 14 days before they take effect; continued use after that date constitutes acceptance.
